1. Who this is

Sable Studios ("Sable Studios," "I," "me," or "my") is an individual, one-person operation run by Nick, providing VRChat character art, avatar commissions, streaming, and marketplace assets. Sable Studios is not a registered company; "Sable Studios" is a trading name.

These Terms of Use govern your use of the sablestudios.xyz website (the "Site"). They are separate from, and do not replace, the Commission Terms, which apply specifically if you commission work from me. If there's a conflict between these Terms and the Commission Terms on a matter specific to a commission, the Commission Terms govern.

By using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

2. Using the Site

You may browse the Site, view the portfolio, and submit a commission enquiry through the contact form for personal, non-commercial purposes. You agree not to:

• use the Site for any unlawful purpose, or in a way that could damage, disable, or impair it;
• attempt to gain unauthorised access to any part of the Site or its underlying systems;
• scrape, copy, or reproduce Site content beyond normal browsing, without permission;
• submit false, misleading, abusive, or harassing information through the contact/commission form;
• use the Site to attempt to infringe anyone's rights, including intellectual property or privacy rights.

3. Age requirement

The Site is intended for users aged 16 or over. Adult (18+) content referenced on the Site is available only as an optional, request-only element of paid commissions, subject to age verification, as set out in the Commission Terms. Adult content is never publicly displayed on the Site itself.

4. Intellectual property

Unless otherwise stated, all portfolio artwork, images, text, branding, and design on the Site are owned by Sable Studios / Nick, or used with permission of the relevant rights holder. You may not copy, reproduce, redistribute, or use this content commercially without prior written permission.

Artwork produced for a specific client through a commission is licensed to that client under the terms set out separately in the Commission Terms — it is not covered by this section.

Third-party trademarks, avatar bases, and assets referenced or shown on the Site (for example, VRChat, base creators, or asset marketplaces) remain the property of their respective owners.

5. Third-party links

The Site links to third-party platforms — including Twitch, Discord, and Jinxxy — for convenience. Sable Studios doesn't control these platforms and isn't responsible for their content, availability, or their own terms and privacy practices. Using them is subject to their own policies.

6. Commission enquiries and payments

Submitting the commission enquiry form does not itself create a contract — it's a starting point for discussion. Any commission, once agreed, is governed by the separate Commission Terms. Payments for commissions are handled off-site (currently via Revolut Pro or PayPal on request) and are not processed through this Site.

7. No warranty

The Site is provided "as is." While I try to keep it accurate and available, I don't guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, and I make no warranties, express or implied, about its content or availability.

8. Limitation of liability

To the fullest extent permitted by law, Sable Studios / Nick is not liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (for example, liability for fraud or death or personal injury caused by negligence).

9. Changes to these Terms

These Terms may be updated from time to time as the Site and studio evolve. The version published on the Site at the time you use it is the one that applies. Material changes will be reflected by an updated "Last updated" date above.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales.
